Terms & Conditions
Welcome to Mouthguards Express. By accessing our website, booking an on-site fitting, or purchasing our custom-fit mouthguards, you agree to comply with and be bound by the following terms and conditions.
1. Scope of Service (Not a Dental Consultation)
No Dental Examination: Mouthguards Express provides a specialised on-site dental impression and custom manufacturing service for sports mouthguards. This service does not constitute a comprehensive dental examination, clinical check-up, or diagnostic consultation.
No Dental Advice: Our staff do not inspect, diagnose, or provide clinical advice regarding dental decay, periodontal health, jaw alignment, or any other underlying oral health conditions.
Encouragement of Routine Care: Our services are not a substitute for regular professional dental care. We strongly encourage all players to maintain routine dental check-ups and oral examinations with their chosen independent dental care provider.
2. Specialised Dental Conditions & Fitting Liability
Mixed Dentitions & Tooth Exfoliation (Losing Baby Teeth): Mouthguards Express manufactures custom guards based entirely on the precise state of the player's teeth on the exact day the impression is taken. For growing players with mixed dentition, we cannot be held liable, responsible, or financially at fault if a mouthguard fails to fit properly in the future due to the natural exfoliation (loss) of baby teeth or the subsequent eruption of new permanent teeth after the fitting date. No refunds or free replacements will be issued for fit issues arising from natural dental growth and changes.
Active Orthodontic Treatment: We strictly do not recommend or advise a custom-fit mouthguard for individuals undergoing active orthodontic treatment. This includes, but is not limited to, fixed conventional braces, Invisalign or alternative clear aligners, and removable expansion retainers. Because orthodontic appliances actively alter arch width, tooth alignment, and jaw positioning on a week-to-week basis, a rigid custom-fit guard will quickly cease to fit and may actively interfere with orthodontic progress.
Assumption of Risk for Orthodontics: If a customer chooses to proceed with a booking and dental impression despite a player having active fixed or removable orthodontic appliances, they do so entirely at their own risk. Mouthguards Express accepts zero liability for poor fit, damage to orthodontic hardware, or disruption to dental treatment, and will not issue refunds under these circumstances.
3. Private Health Fund Rebates Disclaimer
No Guarantee of Rebates: While our custom mouthguards are manufactured to professional dental-laboratory standards, Mouthguards Express makes no guarantee, representation, or warranty that your private health insurance fund will provide a rebate or cover any portion of the purchase price.
Customer Responsibility: Eligibility for rebates depends entirely on your specific health fund provider, your chosen level of cover, and their internal policy rules regarding mobile clinician-led services. Mouthguards Express cannot be held liable, responsible, or financially obligated to offer discounts or refunds in the event that your private health fund rejects or minimises your claim.
4. Ordering, Payments, and Manufacturing
Custom Manufactured Goods: Because our mouthguards are custom-made to an individual's unique dental impression, production begins immediately after the impression is taken.
Payment Terms: Orders must be paid in full online prior to or at the time of the scheduled fitting session.
5. Cancellations, Refunds, and Returns
Change of Mind: Due to the bespoke, custom-manufactured nature of our products, refunds or cancellations cannot be provided once a dental impression has been successfully taken.
Session Absence: If a player misses a confirmed club fitting night, please contact us immediately to arrange an alternative solution or designated backup option.
Manufacturing Defects: We take pride in our 100% Australian dental-laboratory quality. If there is a structural manufacturing defect or fit issue upon delivery, you must notify us within 14 days of receiving the mouthguard to arrange adjustments.
6. Delivery
Completed mouthguards—safely packed in protective storage cases—will be delivered directly back to the club for distribution within 10–14 days of the fitting session, unless otherwise specified.
7. Limitation of Liability
While our mouthguards are engineered using high-impact certified materials to significantly reduce the risk and severity of dental injuries, no mouthguard can guarantee total immunity from injury during sports participation.
